Ohio Legal Separations
Legal separation is a process very similar to divorce proceedings. However, legal separation does not carry the permanency or legal implications that a divorce or dissolution has for marriage. Legal separation is often chosen by people who have religious convictions against divorce, would like to pursue a trial separation before divorce or would like to maintain the legal benefits of marriage for insurance purposes or other personal reasons. It is important to note, many insurance policies now carry provisions that deny coverage to a spouse after legal separation so it is advisable to check your insurance policy first.
Spouses proceeding through legal separations still need to make decisions (or ask the court to make decisions) regarding many of the same issues involved in divorces:
- Property division
- Child custody and visitation
- Child support
- Spousal support
However, additional concerns may also need to be addressed in a legal separation, such as how the mortgage will continue to get paid and how the couple will deal with future debt acquired by one spouse.
